Rules and Conditions
The Ford F-150 Giveaway (hereinafter the “Raffle”) is a fundraising effort being conducted by the Nittany Lion Wrestling Club (hereinafter “NLWC”), a 501(c)(3) not-for-profit charitable organization. The F-150 Giveaway Official Rules and Regulations (hereinafter the “Official Rules”) are set forth below. By purchasing a Raffle ticket (hereinafter a “Ticket”), the purchaser acknowledges that he or she is aware of and agrees to be bound by these Official Rules and the NLWC interpretation of any such Official Rules. The NLWC shall be responsible for interpreting and applying the Official Rules. The NLWC interpretation and application of such rules shall be final. By entering, participants agree (a) to be bound by the Official Rules, (b) that the decisions of the judges are final on all matters relating to the Raffle, and (c) to release the NLWC and its agents and their respective parent companies, subsidiaries and affiliates, and each of their respective officers, directors, employees and agents from any and all liability, loss, or damage arising out of their participation in the Raffle or with respect to the awarding, receipt, possession, use and/or misuse of any prize. The NLWC reserves the right to cancel the Raffle or change any element thereof, with or without notice, and at any time due to printing errors or other mistakes in the production of the Raffle.
Eligibility
Any individual, who is eighteen (18) years of age or older at the time of the purchase of the Ticket, is eligible to enter the Raffle. The NLWC employees and Board of Directors are excluded from participating in the Raffle and are ineligible to win a prize. All federal, state, and local laws and regulations apply. The Raffle is void where prohibited by law.
How to Enter
Entries are $100.00 each and shall be in the form of Tickets with a four-digit number on each from 001 through 1000. Only one (1) eligible person may be entered in the Raffle per Ticket sold. If the name of more than one (1) person is provided on a Ticket entry form and that Ticket is selected as a winning ticket, then the person named first will be deemed as the holder of record of that Ticket and declared the winner. The division of any prize among a group of persons purchasing a Ticket in common shall be to the sole responsibility of the person named as the holder of record of that Ticket should that Ticket be selected as a winner. The NLWC is not responsible for resolving any disputes that may arise from different individuals listed on a winning Ticket. Tickets will be sold through the NLWC Pre-Golf Social on August 29, 2024, but may sell out before that time. An individual can purchase as many Tickets as he or she may wish, subject to availability. Tickets may be purchased:
In Person. Tickets are available at the Stuckey Ford Dealership, 2892 Benner Pike, Bellefonte, PA 16823 as well as various ticket locations that will be advertised through NLWC social media channels. Monies must be received before a ticket is given. Tickets can be paid for with either personal check or cash. The NLWC reserves the right to reject any entry form that is submitted without proper payment or payment that does not constitute “good funds.” No refunds will be made. Upon receipt and acceptance by the NLWC of a proper entry form, a receipt (ticket stub) of purchase will be provided to the purchaser. Any defective or physically altered entry form, or entry form received without proper or sufficient payment, will be immediately disqualified by the NLWC. The NLWC will not be responsible for entries that are not received by the NLWC for any reason. Prior to the drawing, the NLWC may make a reasonable effort to notify the individual of a rejected or disqualified entry by attempting to make contact through the information provided at the time of the Ticket purchase request. Neither the NLWC nor its directors, officers, employees, agents or other representatives assumes any responsibility or liability for lost, late, misdirected, mutilated, incomplete, illegible or undelivered entries, or any other failure to receive entries, or any failure to deliver a receipt of purchase prior to the drawing deadlines.
Prize
One (1) Prize shall be awarded, which consists of a 2024 Ford F-150 4x4 STX SuperCrew outfitted with a Diamondback truck cover or $25,000.00 in cash. The participant can select whichever of these two options they prefer. If the winner selects to receive the 2024 Ford F-150, the automobile shall be provided by John Stuckey Ford, Inc., DBA Stuckey Ford (the “Dealer”) at 2892 Benner Pike, Bellefonte, PA 16823.
Determining the Winner
The winner will be determined by a drawing which will occur at the NLWC Pre-Golf Social on August 29, 2024. To be eligible for this drawing, the entry must be received up to 10 minutes prior to the drawing at the pre-golf social. The award of the prize is subject to the terms and conditions of these Official Rules. Prizes are as follows: 2024 F-150 or $25,000.00 in cash.
Prize Acceptance
Prize is non-refundable and subject to availability. If fewer than 700 Tickets are sold by the ticket sale deadline, the Raffle will be held as scheduled, except that the Prize winner will receive a cash prize equal to 50% of the total Ticket proceeds received by the NLWC and no greater than $25,000. For example, if 50 tickets are sold, and the total gross proceeds of tickets is $5000, the winner would receive a grand prize of $2500, or 50% of raffle proceeds. The Prize winner assumes any and all fees, local, state, and federal taxes, including, but not limited to, income taxes based on the value of the prize. All non-cash prizes may not be exactly as described, are based on availability and the NLWC may substitute with a prize of similar value. The Prize winner will directly coordinate prize delivery with the NLWC. Any taxes and fees, including all fees associated with licensing and registering the vehicle, are the responsibility of the winner. Winner of the prize must comply with all applicable laws regarding the elected prize.
Winner agrees to accept the Prize “as is” and entrants hereby acknowledge that the NLWC is not in any manner responsible or liable for any warranty, representation, or guarantee relative to the Prize, including warranties provided exclusively by the Prize manufacturer. Winner understands that there are inherent risks involved in owning and operating an automobile and acknowledges that the NLWC, and John Stuckey Ford, Inc., DBA Stuckey Ford, shall not be responsible or liable in any way for any damages, expenses, taxes, fees, losses, repairs, injuries, or any other costs stemming from ownership of the Prize after the Winner takes possession of the Prize. Winner must provide the NLWC with a valid social security number or taxpayer identification number before prize will be awarded. The NLWC will provide the Winner with an appropriately completed W-2G form. The NLWC will report winnings to the IRS. If the Winner elects to receive the Prize in the form of the vehicle, Winner must deposit $15,565.2 - 28% of the value of the prize, as a tax deposit for income tax to be forwarded by the NLWC to the IRS.
No Substitutions
Under no circumstances will any Raffle Winner be allowed to request substitution, alteration, or exchange of any prize being offered by the NLWC. The Prize, as described above, will not be substituted, exchanged or altered in any fashion.
Notification of Winners
Winners will be notified according to the contact information provided to the NLWC at the time of Ticket purchase. If the Prize winner cannot be located by 5:00 p.m. on September 6, 2024, after reasonable attempts to make contact through the information provided at the time of purchasing the ticket, such winner will be deemed invalid and a new winner will be drawn. A copy of the winners’ list and of these Official Rules may be obtained by sending a self-addressed, stamped envelope to: Nittany Lion Wrestling Club, P.O. Box 316 State College, PA 16804. Requests must be received within 30 days of the close of the Raffle.
Non-Deductibility of Ticket Purchase
The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently the purchase of a Ticket does not qualify as a deductible charitable contribution.
Taxes
There may be federal, state and/or local tax consequences of winning a prize in this Raffle. Any and all taxes are the sole responsibility of the winner. Each purchaser of Tickets is advised to consult his or her own tax advisors with respect to tax liabilities that may arise from winning a prize in this Raffle. Winners of prizes of $1,000 or more may be required to submit a W-2G, Form 5754 or similar tax form (provided by the NLWC) for tax withholding purposes.
Fees and Sales Tax Due
There may be state sales tax consequences of winning a prize in this Raffle. If the Winner selects to receive the 2024 Ford F-150 as the Prize, there may be dealer fees, documentation fees and vehicle state registration fees which will be due and owing in full upon receiving possession of the 2024 Ford F-150. All state sales tax, dealer fees, documentation fees and vehicle state registration fees are the sole responsibility of the winner. Dealer is not responsible for any costs, fees or taxes associated with the transfer or deliver of the 2024 Ford F-150.
Miscellaneous Conditions
The Raffle is subject to these Official Rules. By entering into this Raffle, you are conclusively deemed to have agreed to be bound by these contest rules and terms and conditions as well as by any rules specific to such Raffle. This is an irrevocable condition of entry. These Official Rules cannot be changed by any oral statement made by any employee, consultant, volunteer, or agent acting on behalf of the NLWC. By entering this Raffle, entrants accept and agree: (1) to be bound by these Official Rules and the decisions of the NLWC, which shall be final and binding, (2) to waive any right to claim ambiguity in the Raffle or these Official Rules, and (3) that the NLWC may use the entrant’s name, photograph, likeness, statements, biographical information, voice and city of habitation for promotional or advertising purposes in connection with the Raffle on a worldwide basis and in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation, except where prohibited by law. Other rules and regulations may apply. Please contact the NLWC if you have any questions.
This Raffle is void where prohibited by law. The Small Games of Chance License owned may be viewed at upon request to the the NLWC.
By Entering This Raffle, Each Entrant Releases the Nlwc, Its Directors, Officers, Employees and Agents From Any and All Liability for Injuries, Losses or Damages of Any Kind (Including, Without Limitation, Attorney’s Fees) Caused by Participating in the Raffle or Winning Any Prize or Resulting From Acceptance, Possession, Use or Misuse of Any Prize, and Each Winner Agrees to Indemnify and Hold the Nlwc Harmless From Any and All Losses, Damages, Rights, Claims and Actions of Any Kind Arising From, in Connection With, or as a Result of Participating in the Raffle or the Winner’s Acceptance or Use of Any Prize. A Raffle Entrant’s Sole and Exclusive Remedy for Any Claim Against the Nlwc Arising Out of the Sale of Tickets or the Conduct of the Raffle Shall Be Limited to the Return of the Purchase Price Paid for His or Her Ticket(S). In No Event Shall the Nlwc, Its Directors, Officers, Employees, Agents or Representatives Be Liable to Any Party for Any Loss or Injuries to Earnings, Profits or Goodwill, or for Any Incidental, Special, Punitive or Consequential Damages of Any Person or Entity Whether Arising in Contract, Tort or Otherwise, Even if Advised of the Possibility of Such Damages.
The NLWC reserves the right in its sole and absolute discretion to alter any contest rules at any time.
Cancellation/Termination of Raffle
By purchasing a Ticket and choosing to participate in the Raffle, each Raffle participant acknowledges and agrees that the NLWC has the right, in its sole discretion, to elect not to proceed with the Raffle for any reason whatsoever or for no reason, and in such event, a participant’s sole and exclusive remedy shall be to receive a refund of the full price paid by such participant for each Ticket purchased, without interest.
Odds
The odds of winning depend on the number of Tickets sold prior to the drawing date. No more than 1000 tickets will be sold. Therefore, if every ticket sells, the odds of winning are 1 in 1000.
Non-Interference with Tickets
The NLWC has the right, in its sole discretion, to maintain the integrity of the Raffle through voiding entries for any reason, including attempts to fake or counterfeit entries into the Raffle. Any attempt to deliberately damage, interfere with, or counterfeit entries into the Raffle may be a violation of criminal and civil laws and the NLWC reserves the right to seek damages from any such person to the fullest extent permitted by law, including but not limited to all available civil remedies and referral for criminal prosecution.
Disputes
This Raffle is governed by the laws of the Commonwealth of Pennsylvania without respect to conflict of law doctrines. As a condition of participating in this Raffle, participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Raffle shall be resolved individually without resort to any form of class action. Jurisdiction in all causes of action in regard to this Raffle shall be exclusively in a court located in Centre County, Pennsylvania. All participants in the Raffle agree, as a condition of entry, to waive all rights to claim punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Raffle) and participant further waives all rights to have damages multiplied or increased.
